Order of the National Green Tribunal in the Vivek Kamboj & Others Vs Union of India & Others dated 14/03/2019. The issue for consideration is the remedial measures against contamination of ground water on account of leachate discharge adversely affecting the inhabitants and failure to comply with solid waste management norms, including burning of waste. Foul smell emitted by the garbage dumped is affecting the air quality.

The Tribunal after considering the matter on 01.03.2019 and 05.03.2019 noticed that Gurgaon is named as the most polluted city. and the failure also noticed the failure in the present case resulting in damage to the environment. The Commissioner, Municipal Corporation, Gurgaon was directed to file an action plan.

NGT observes that the action plan which has been filed proposes setting up of segregation unit for the incoming waste and inviting experts for scientific treatment of legacy waste and leachate. Tribunal feels that since most of the remedial actions mentioned in action plan are proposed to be undertaken in future, in the light of serious past failures, it will be appropriate that the Municipal Corporation, Gurgaon is required to furnish performance guarantee in the sum of Rs. 25 lakhs to the satisfaction of CPCB within one month undertaking to comply with the steps mentioned in the action plan. A compliance affidavit would be filed by the Commissioner, Municipal Corporation, Gurgaon within one month.
