Order of the Supreme Court of India in the matter of M. C. Mehta Vs Union of India & Others dated 30/01/2020 regarding permission to fell trees to build three railway over bridge projects in Uttar Pradesh.

Central Empowered Committee (CEE) has recommended construction of the railway over bridges to ease the traffic congestion in the proposed three railway intersections and that the projects are in public interest. Also the bridges would reduce the load of vehicle pollution and that around 103 trees need to cut/translocated. Further one ha of land has been identified for plantation of trees in Mauja Mutavai Tehsil and the expenses would be borne by the project proponent.

In pursuance of the CEE report, the SC grants permission for felling of trees for the overbridges subject to certain conditions like the Social Forestry Division, Agra, would undertake compensatory planting of 1000 plants of indigenous species in 1 ha of land in Gata No.10 of Majua Mutavai Tehsil, Fatehbad at the cost of the Uttar Pradesh State Bridge Corporation Ltd.
