Order of the National Green Tribunal (Eastern Zone Bench, Kolkata) in the matter of Anil Kumar Singh Vs State of Jharkhand & Others dated 14/02/2022.

The matter related to setting up of a compressed bio gas plant at Ranchi by GAIL. It is said that no consent to establish (CTE)/consent to operate (CTO) has been issued by the Jharkhand State Pollution Control Board as per the Water Act, 1974 and the Air Act, 1981 to the Ranchi Municipal Corporation for dumpsite located at Jhiri.

The NGT in its order, November 17, 2021 had directed the Ranchi Municipal Corporation to file an affidavit stating as to whether they have applied for environmental clearance for the waste to gas plant in coordination with GAIL as well as whether they have filed the application for obtaining Consent to Establish (CTE) and Consent to Operate (CTO) with the Jharkhand State Pollution Control Board. However, no affidavit has been filed till date.

The NGT, February 14, 2022 directed the matter to be listed for February 24, 2022 and directed the Municipal Commissioner, Ranchi Municipal Corporation to be also present before the court.
